FOCUS OF THE DAY: Ministry of Justice officials have met frontline legal services regulators for discussions on the future of the profession, the lord chancellor has revealed. Michael Gove pledged in June to conduct a review of the Legal Services Act within the current parliament. He said then that the act, which set up the current legal services regulatory system, creates a ‘danger of regulators falling over each other’s feet’. The date for the review remains unknown, but Gove has confirmed that civil servants have begun the ground work through talks with the SRA, BSB and other interested groups. FOCUS OF THE DAY: There are positive signs about improving consumer satisfaction with how they find, compare and then use law firms, major research by the Legal Services Consumer Panel (LSCP) has revealed. However, with reduced access to legal aid and a “continued decline in free services”, the panel said that more vulnerable consumers “are potentially being left behind as those more empowered are able to take advantage of market changes”. Such empowered consumers are more likely to shop around – which is becoming easier, with more choice – and demand fixed fees. Full story - Legal Futures

FOCUS OF THE DAY: The foundations of the rule of law in the UK are weakening, and threatening the UK’s appeal to international investors as a result, a searing report by Linklaters has claimed. The report, In defence of the rule of law, identifies five key threats to the rule of law within a business context: excessive executive power; retroactivity; uncertainty; unmanageability; and changes in the burden of proof. It argues that the rule of law is being undermined by broadly drafted laws that, in practice, allow the regulators or prosecuting authorities to decide what is illegal, eg s 75 of the Banking Act 2009 gives the Treasury the power to disapply or modify the effect of any law without Parliamentary approval, and the financial services industry as a whole increasingly relies on “principles-based regulation”.
