Sunday Op-Ed: 

LawNewsIndex was founded in 2011 as a way of cataloguing the ongoing changes in the UK justice system as well as documenting social justice related conversations as observed through the Twitter/X account @thelawmap. In the proceeding decade and half LawNewsIndex collated thousands of articles documenting the ebb and flow of time and how British society and the justice system responded to local and international events. This present archive on justice, law and societal changes covers each and every day since December 2011. Starting in July 2026 a weekly 'Sunday Editorial' column has been added:

Utilitarianism in an Age of Permanent Crisis: Britain has become a nation of calculators. Chancellors speak the language of fiscal headroom, ministers invoke value for money with liturgical regularity, and civil servants are armed with impact assessments that promise to convert the untidy business of human existence into columns of measurable outcomes. Whether the question is NHS waiting lists, artificial intelligence, prison overcrowding or the perennial crisis in social care, the instinct is remarkably consistent: weigh the costs, estimate the benefits and pursue the course that promises the greatest advantage for the greatest number.

This is, whether acknowledged or not, the enduring legacy of utilitarianism. For a philosophy born amid the furnaces and factories of Britain's industrial revolution, utilitarianism has aged with astonishing resilience. It remains embedded not only within Whitehall but within the assumptions of late capitalism itself. Every algorithm ranking our news feeds, every Treasury cost-benefit analysis, every debate over net zero, HS2 or the allocation of scarce NHS resources reflects an ethical disposition that privileges consequences over intentions. The question is rarely whether an action is intrinsically right, but whether it works.

Yet Britain in 2026 appears increasingly suspicious of arithmetic masquerading as morality. The politics of austerity offered perhaps the clearest illustration. Defenders argued that difficult fiscal decisions would ultimately restore economic stability and serve the national interest. Critics countered that aggregate economic gains meant little to communities hollowed out by closed libraries, diminished local government and chronically underfunded public services. The spreadsheets balanced; the social contract did not. Here, the central promise of utilitarianism collided with a stubborn political reality: averages conceal suffering.

John Stuart Mill understood this tension more profoundly than many of his modern admirers. Too often remembered simply as the philosopher of "the greatest happiness", Mill was far more subtle than the managerial utilitarianism that now dominates public policy. He recognised that happiness is not merely a question of accumulation but of cultivation. The pleasures derived from literature, democratic participation, intellectual enquiry and artistic creation could never be equated with the transient satisfactions of consumption. A society rich in entertainment yet impoverished in civic life would not, for Mill, be genuinely prosperous.

That insight feels almost prophetic in twenty-first-century Britain. We inhabit a culture saturated with distraction yet haunted by loneliness; more connected technologically than at any point in history, yet persistently fragmented socially. Social media platforms optimise engagement with extraordinary efficiency, but their success has often amplified outrage rather than understanding, tribalism rather than citizenship. The algorithm, perhaps the purest utilitarian invention of the digital age, maximises measurable satisfaction while quietly eroding the conditions that sustain democratic life.

Mill's defence of liberty therefore deserves renewed attention. Freedom was never, in his account, merely the absence of interference. It was the indispensable condition for intellectual and moral development. A society confident enough to tolerate disagreement was, ultimately, a society capable of correcting its own mistakes. That proposition carries uncomfortable implications for contemporary Britain, where political discourse increasingly rewards certainty over reflection and outrage over persuasion.

It is precisely here that John Rawls enters the conversation—not as an enemy of utilitarianism but as its most devastating liberal critic. Rawls recognised that a society may become wealthier in aggregate while remaining profoundly unjust in its distribution of opportunity. The "veil of ignorance" remains one of political philosophy's most elegant thought experiments because it compels us to imagine institutions without knowing whether we ourselves will occupy positions of privilege or precarity. Would we design Britain's housing market, tax system or educational landscape in quite the same way if we did not know whether we would inherit wealth or rely upon food banks?

Recent debates over inheritance, regional inequality and access to healthcare reveal precisely the questions Rawls anticipated half a century ago. Economic growth, valuable though it undoubtedly is, cannot become the sole measure of national success if its rewards are captured disproportionately by those already advantaged. A politics content with rising GDP while social mobility stagnates mistakes prosperity for justice.

Karl Popper would have regarded much of Britain's recent political history with characteristic scepticism. Grand promises—to "level up", to "take back control", to engineer a high-growth economy through sweeping constitutional or economic reforms—would have struck him as examples of the dangerous temptation to believe that complex societies can be redesigned according to ideological blueprints. Popper's preference for piecemeal social engineering appears almost unfashionably modest today. Yet its intellectual humility has rarely looked more attractive.

Brexit itself, whatever one's position on its merits, illustrated Popper's deeper point: complex systems seldom respond predictably to sweeping interventions. Human societies are not laboratories. Policies generate unintended consequences because people are not variables to be manipulated but citizens possessed of agency, memory and competing loyalties.

Perhaps this is the enduring lesson that Mill, Rawls and Popper collectively offer Britain today. Utilitarianism remains indispensable because governments must make choices under conditions of scarcity. Resources are finite; priorities must be established. Yet politics ceases to be democratic the moment efficiency becomes its only virtue. Liberty cannot be reduced to productivity, justice cannot be captured by averages, and wisdom demands the humility to recognise that every policy, however carefully calculated, remains open to criticism and revision.

In an age increasingly seduced by metrics, dashboards and algorithms, the most radical proposition may be that not everything of value can be counted. The health of a democracy resides not merely in economic growth or statistical wellbeing, but in the dignity afforded to individuals, the fairness of its institutions and the willingness of its citizens to disagree without imagining that disagreement itself is a social failure. Utilitarianism still has much to teach us. It simply cannot be permitted to have the last word.
