FOCUS OF THE DAY: An equal gender balance among practising barristers is “unlikely ever to be achieved” if current trends continue, a Bar Council report has warned.The report found that the “lower propensity” of women to move into practice and “higher attrition rate” in practice meant that only if almost 60% of those called to the Bar were women would equality then prevail in the ranks of practising barristers. FOCUS OF THE DAY: MPs David Davis and Tom Watson have succeeded in their judicial review challenging the data retention powers in section 1 of DRIPA—the Data Retention and Investigatory Powers Act 2014. The legislation that was fast-tracked through Parliament to plug a gap left when the Data Retention Directive 2006/24/EC was annulled by the Court of Justice of the European Union (CJEU) in the Digital Rights Ireland case [2014] 2 All ER (Comm) 1. The CJEU found that it interfered with rights under Arts 7 and 8 of the EU Charter of Fundamental Rights, corresponding to Art 8 ECHR. However, DRIPA broadly replicated the Data Retention Directive regime. Full story - New Law Journal

FOCUS OF THE DAY: The criminal bar has recommended direct action over legal aid cuts begin on 27 July after barristers voted in favour of supporting solicitors who are currently boycotting new legal aid work. Members of the Criminal Bar Association voted in favour of no new work and ‘no returns’ to support solicitors’ action by 982 votes to 795 – equating to 55% in favour and 45% against – though on a low turnout of about 45%. However, the executive committee said this morning that it ‘recognises that the vote represents the will of the CBA’s members and it has therefore decided to put in place a protocol to ensure that those taking action comply with their professional obligations’. Just as every doctor is accustomed to being pestered by friends and family about their various ailments (real or imagined), so lawyers are familiar with their views being sought on everything from planning spats to package holiday disasters.
