FOCUS OF THE DAY: Online divorce and probate are set to be delivered under the courts modernisation programme by early 2017, the president of the Family Division has said. Addressing the Family Law Bar Association, Sir James Munby also called on barristers to adopt new working practices, including direct access, unbundling and fixed fees. FOCUS OF THE DAY: Partners are delaying retirement because of recent cuts in pension saving for high earners, creating a bottleneck at the senior end of the profession, according to research by accountants Smith & Williamson. Its 21st Annual Survey of the Professional Services Sector shows that more than half of the partners questioned expect a rise in the retirement age to affect opportunities for partner development and hence succession planning. The accountants also report that 90% of the 95 firms surveyed leave individual partners to organise their own retirement planning. Full story - New Law Journal

FOCUS OF THE DAY: The judiciary is proposing a ban on fee-charging McKenzie friends in order to protect ‘vulnerable litigants’ from unregulated and uninsured individuals. In an eagerly awaited consultation on the issue, published today, the judiciary also recommends that all McKenzie friends sign up to a code of conduct, and that rules governing the courts’ approach to McKenzie friends be legally codified. The consultation follows mounting concerns over the behaviour of such practitioners after a former nightclub bouncer was last year barred from acting as a McKenzie friend after calling a lawyer a ‘lying slag’.
