FOCUS OF THE DAY: Litigation lawyers have given a cautious welcome to the Civil Justice Council’s (CJC) recommendations on damages-based agreements (DBAs). DBAs, a "no-win no-fee" funding option under which the lawyer takes a percentage of the damages if the case is successful, were one of the key civil litigation funding reforms set out by Lord Justice Jackson in his 2009 report. Last month Mr Justice Snowden, of the Chancery Division, handed down a judgement concluding a four-year legal battle between the Financial Conduct Authority (FCA) and Da Vinci Invest Ltd, a UK-registered but Swiss-based fund manager, a Da Vinci Singaporean entity, three individual traders based in Hungary and their Seychelles company.
