FOCUS OF THE DAY: The introduction of fixed costs for small multi-track cases such as low-level building disputes could be a way to achieve proportionate costs, according to Lord Neuberger. In an address to the Manchester Law Society and Northern Circuit Commercial Bar Association, Lord Neuberger, President of the Supreme Court, said costs management would take time to “bed down” but that, if it did not work, there would be no alternative but to go over to fixed costs. The House of Commons Public Accounts Committee said the MoJ is still playing ‘catch up’ almost two years after reducing the scope of civil legal aid, with ‘considerable gaps’ in its understanding. FOCUS OF THE DAY: The European Court of Human Rights (ECtHR) has upheld the right of UK courts to impose whole-life prison sentences on those who are jailed for life. Over-ruling its decision in 2013, the Strasbourg court ruled six to one that the justice secretary has the power to release those serving whole life term in exceptional circumstances, which meant such a sentence complies with article 3 of the European Convention of Human Rights.
