FOCUS OF THE DAY: At a time when “the cost of legal services has generally been allowed to rise to unsustainable levels”, lawyers and the clients need to reconnect the four key ingredients that go into the purchase of legal services – cost, price, value and relationship – Professor Stephen Mayson has argued. A key element is that law firms must “constantly work and innovate to keep their costs as low as possible, consistent with their intended client-base and position in the market”. This did not mean it was just about efficiency, he continued. “But it certainly all starts with efficiency: without it, a firm will not have kept its cost-base within reasonable bounds, or then its pricing within market expectations; and without cost-efficiency, there is little scope for client perceptions of value for money, or a sound basis for a continuing relationship.” Full story - Legal Futures

FOCUS OF THE DAY: Lowering the professional indemnity insurance (PII) threshold would not necessarily reduce costs and could only have “downside risk”, City lawyers have warned. Responding to Solicitors Regulation Authority suggestions in a July discussion paper that the PII minimum cover of £2m could be reduced to as low as £500,000 in some cases to reduce premiums and promote greater flexibility in the profession, the City of London Law Society (CLLS) expressed concern. FOCUS OF THE DAY: The increase in advertising legal services is having a negative effect on the justice system, according to a survey of 1,261 members of the public. The poll, conducted by Britain Thinks, found that 71% of people thought that advertising had increased in the last three years, and of them, two-thirds thought it had a negative effect on the justice system. There were similar findings in relation to the growth of ‘no win, no fee’ cases, while there was even greater negativity over “people ‘trying their luck’ to get compensation” and sales calls or texts. FOCUS OF THE DAY: The Solicitors Regulation Authority has hit back at claims that it has pre-empted formal consultation on how it will assess trainees under proposed new routes into the profession. Last week the Law Society said it was ‘deeply concerned’ that the SRA had expressed its preference for one of three proposed training routes before consulting the profession. The Society said that the SRA's preferred route would involve centralised assessments against the competence statement for solicitors published in April. The statement would replace mandatory training contracts, the legal practice course or a law degree. Full story - The Law Society Journal
